• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.               No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.     The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory Condition where the licence authorises the exhibition of films

   

  (a)               Where a club premises certificate authorises the exhibition of films, the certificate must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this condition.

   

  (b)               Where the film classification body is specified in the certificate, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendations made by that body.

   

  (c)               Where -

   

  (i)                   the film classification body is not specified in the licence; or

   

  (ii)                            the relevant licensing authority has notified the premises which holds the certificate that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  (d)               In this section -

   

                              “children” means persons aged under 18; and

   

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

  1.              The pub is an active member of the local pub watch scheme and liaises closely with the designated pub watch police officer.

   

  2.              Being a community pub the customers can be said to be self regulating as regards the standard of behaviour expected on the premises.

   

  3.              The pub is very clean and tidy with no obvious hazards to public safety.

   

  4.              All emergency exits are labeled and lit.

   

  5.              There is a functioning fire alarm system and both it and the emergency lighting system is regularly checked by an outside contractor (Chubb).

   

  6.              Fire extinguishers are located at various points in the building and those are also checked regularly.

   

  7.              Under age drinking is not tolerated and staff are well versed in dealing with this situation.  The check 21 scheme is also in operation and notices of this are posted at the bar.

   

  8.              People who are obviously over the limit when entering the pub are not served and every reasonable effort is made to escort them from the premises.

   

  9.              Unaccompanied children are not allowed on the premises and children must be under the supervision of an adult at all times.

   

  10.              Accompanied children are allowed on the premises until 18:00 hrs weekdays and 17:30 hrs Saturdays and Sundays.
