• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.               No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.     The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) (Amendment) Order 2014

  1.               (1)              The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2)               In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

  (a)               games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

  (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

  (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

  (d)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e)              dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

  2.               The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

  3.                (1)                The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2)               The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3)               The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a)              a holographic mark, or

  (b)              an ultraviolet feature.

  4.                The responsible person must ensure that-

  (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i)              beer or cider: ½ pint;

  (ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)              still wine in a glass: 125 ml;

  (b)              these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c)              where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2014

   

  1.               A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  2.               For the purposes of the condition set out in paragraph 1 -

   

  (a)               “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(6);

  (b)               “permitted price” is the price found by applying the formula -

   

  P = D + (D x V)

   

  Where -

   

  (i)               P is the permitted price,

  (ii)               D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii)               V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

   

  (c)                “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

   

  (i)               the holder of the premises licence,

  (ii)               the designated premises supervisor (if any) in respect of such a licence, or

  (iii)               the personal licence holder who makes or authorises a supply of alcohol under such a licence;

   

  (d)               “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

   

  (e)              “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994(7).

   

• CONDITION AGREED WITH CUMBRIA FIRE AND RESCUE SERVICE

   

  1.              The first floor should be limited to a maximum occupancy figure of 60 persons, to meet the requirements of Approved Document B of the Building Regulations.

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

    1.              No alcohol to be consumed off the premises.

   

    2.              Window to be kept closed at all times except in the event of an emergency.

   

    3.              Rear fire door to be kept closed except in the event of an emergency.

   

    4.              Noise emitting from the premises shall at no time cause disturbance to local residents.

   

    5.              The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents.

   

    6.              There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public (or member and their guests) notices pointing out the needs of local residents and the need to leave the premises and the area quietly. (Note:  this may also include reference to vehicles.)

   

    7.              CCTV installed and images retained for a period of 7 days. Images to be stored for additional time on separate hard drive at the request of responsible authorities.

   

    8.              Children’s admission 10:00 a.m. to 7:00 p.m.   SUPERCEDED BY MINOR VARIATION OF PREMISES LICENCE ON 18 MARCH 2014.

   

    9.              No person under the age of 18 to remain in the bar area during permitted hours with the exception of the staff’s children. Access to the bar by persons under the age of 18 is only permitted for the purpose of passing to or from the upstairs games room.  SUPERCEDED BY MINOR VARIATION OF PREMISES LICENCE ON 18 MARCH 2014.

   

  10.              Any person under the age of 14 will be accompanied by an adult at all times.  SUPERCEDED BY MINOR VARIATION OF PREMISES LICENCE ON 18 MARCH 2014.

   

  11.              The licence holder will conduct regular assessments of the number of persons in the licensable area. If applicable the licence holder shall take steps to reduce numbers to an acceptable level.

   

   

• CONDITION IMPOSED BY LICENSING PANEL  AT A VARIATION HEARING ON 15 JUNE 2011

   

  1.              A sound assessment be carried out by Environmental Health and that assessment to be agreed with Allerdale Borough Council before the variation can take effect.

   

  2.              All licensable activities to cease at 23:00.

   

  3.              Extra CCTV cameras be fitted to cover all areas inside and outside of the premises and the CCTV footage to be stored for 1 month.

   

  4.              External doors and windows

                All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency.

   

  5.              Noise assessments

                The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action.

   

  6.              Lobby entrance

                All entrances and exits have a lobby entrance with at least one set of doors closed at all times to minimise the breakout of noise.

   

  7.              Electrical Installation Testing

                The electrical installation shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an officer of the authority.

   

  8.              RCD

                Each socket outlet circuit or individual socket outlets used for public entertainment shall be protected by an integral residual current device (RCD) having a rated residual operating current not exceeding 30mA (0.03 amps). Every such circuit and residual current device shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.

   

  9.              First Aid

                There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.

   

   

   

• CONDITION IMPOSED BY LICENSING PANEL  AT A REVIEW HEARING ON 23 SEPTEMBER 2011

   

  1.              Live entertainment on a Sunday shall be to a terminal hour of 21.00.

  2.               During hours that the premises are open to the public, staff at the premises shall carry out checks at 15 minute intervals at the front of the premises monitoring behaviour and any drinking outside. Any finding shall be recorded in a specific incident book.

  3.              Within the next 28 days the rear of the premises shall be subject to general cleaning and tidying at the direction of the licence holder.

   

• ADDITIONAL CONDITIONS AGREED BY MINOR VARIATION ON 9 NOVEMBER 2012

   

  1.                  When any function and/or Regulated Entertainment is held at the premises TWO(2) Security Industry Authority registered Door Supervisors will be employed covering a period of 30 minutes before the commencement of; during and 60 minutes following the end of the event.  SUPERCEDED BY MINOR VARIATION OF PREMISES LICENCE ON 18 MARCH 2014.

   

  2.    On Friday between 19:00 and 23:00*, Saturday and Sunday between the hours of 14:00 hours and 23:00 hours a nominated member of staff wearing a HI-VIZ jacket will be positioned at the front door of the premises to prevent customers taking glasses off the premises and to monitor customers behaviour whilst outside (except at times when the SIA register Door Staff are employed, who will then assume this role). SUPERCEDED BY MINOR VARIATION OF PREMISES LICENCE ON 18 MARCH 2014.

   

  3.                A 'hard drive' CCTV system is installed covering all internal public areas and the frontage of the premises including the footway and front door area. Images to be recorded on a 24 hours a day, 7 days a week basis with the images retained for a minimum of 31 days. Images to be provided to any Responsible Authority Officer (i.e. police, fire service Local Authority Officer)

   

   

• ADDITIONAL CONDITIONS AGREED BY MINOR VARIATION ON 18 MARCH 2014

   

  1.              2 x SIA door staff for ANY function, party, event, karaoke or live music for period 1 hour before commencement of said function, party, event, karaoke or live music until 30mins after close of premises (2330hrs).

   

  2              No person under 18 years to be allowed on premises under any circumstances (including staffs children under18, EXCEPT Jake Hardy and Jordan Hardy sons of  PLH & DPS Wayne Hardy who must not work at the premises and only be on the premises when accompanied by Wayne Hardy).

   

  3.              Active challenge 25 policy.

   

  4.              Introduce and use pub radio link.

   

  5.              During hours of 1800-2330hrs Friday-Sunday a member of J.J’s staff wearing high visibility clothing positioned on front door at all times to ensure cigarette disposal bins are used and reduce noise/nuisance of those smoking, entering and leaving premises etc and record any incidents in incident book. AMENDED BY VARIATION TO PREMISES LICENCE ON 26 MAY 2015.

   

  6.              Premises to operate a “Fully plastic - No glass policy”. All sales to be made in plastic containers (any glass bottles to be decanted into plastic drinking vessels - no glass drinking vessels and no glass bottle sales for consumption on or off the premises).

   

  7.              Premises Licence Holder and Designated Premises Supervisor to be present on J.J’s Club premises site for minimum of 14 hours a week (week being Monday- Sunday period with  Premises Licence Holder and Designated Premises Supervisor being present for a period on at least four of the days in that week) and keep a “time & motion type log book” which will have to be made available to authorities for checking (excluding any booked holiday periods) This will provide more involvement of the PLH & DPS in the day to day running of the premises management.

   

  8.              Maximum of 50 persons (including customers and staff) to be on the premises at any one time during Opening/licensed hours 1100-2300 Monday-Sunday inclusive with the exception that if there are 51 persons or above there must be 2 x SIA door staff employed at and present at the premises until close of premises that day (2330hours).
