• EMBEDDED CONDITIONS - RESTAURANT LICENCE

   

  Alcohol may be sold or supplied:

   

  (a)              On weekdays, other than Christmas Day, Good Friday or New Year’s Eve from 10 a.m. to midnight.

  (b)              On Sundays, other than Christmas Day or New Year’s Eve and on Good Friday: 12 noon to 11.30 p.m.

  (c)              On Christmas Day: 12 noon to 11.30 p.m.

  (d)              On New Year’s Eve, except on a Sunday, 10 a.m. to midnight.

  (e)              On New Year’s Eve on a Sunday, 12 noon to 11.30 p.m.

  (f)              On New Years Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day.

   

  The above restrictions do not prohibit:

   

  (a)              during the first twenty minutes after the above hours the consumption of the alcohol on the premises;   REMOVED BY VARIATION OF PREMISES LICENCE ON 24TH NOVEMBER 2005.

  (b)               during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;

  (c)               during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals; or

  (d)               consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises.

   

  Intoxicating liquor shall not be sold or supplied on the premises otherwise than to persons taking table meals there and for consumption by such a person as an ancillary to his meal.

   

  Suitable non-alcoholic beverages, including drinking water, shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.

   

  The premises must structurally and bona fide used for the purpose of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises.

   

  Recorded Music

   

  Provision may be made for the public entertainment in the premises by the reproduction of wireless (including television) broadcasts (or of programmes included in any programme service [within the meaning of the Broadcasting Act 1990] other than a sound or television broadcasting service), or of public entertainment by way of music and singing only which is provided solely by the reproduction of recorded sound.

   

   

• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

  1.              A manager is always present on the premises and there is always one experienced staff member to assist juniors in dealing with difficult customers.

   

  2.              There is little history of order problems, even though customers come from the town centre public houses.

   

  3.              The shop space is limited and there is no seating for groups of people to congregate.

   

  4.              The premises are protected by a CCTV system.

   

  5.              For about 10 minutes before service finishes in the shop the doors are closed and blinds drawn so as not to attract further would be customers.

   

  6.              The business is operated under all current standards for food handling and safety.

   

  7.              The premises are manned by a minimum of two staff.

   

  8.              There are mats on the floor and signs are used to warn of wet floors when appropriate.

   

  9.              The premises are well lit with a spotlight on the door area.

   

  10.              There are no steep steps.

   

  11.              The window is of toughened glass.

   

  12.              The business is not in a residential area.

   

  13.              Noise levels are considered by staff and customers are found usually to be considerate.

   

  14.              Polite requests to noisier customers to moderate behaviour are usually complied with but anyone persisting in rowdiness is asked to leave.

   

  15.              There is a bin for waste and litter on the premises and several public bins in Market Square.             

   

  16.              Litter outside is cleared up daily by the staff and the pavement outside is scrubbed and disinfected once a week.

   

  17.              No activities are carried on at the premises which are harmful to children, who are treated in the same way as other customers.

   

  18.              Staff are aware that enquiry should be made of anyone very young appearing at the shop during late hours.
