• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.               No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.     The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory Condition where the licence authorises the exhibition of films

   

  (a)               Where a club premises certificate authorises the exhibition of films, the certificate must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this condition.

   

  (b)               Where the film classification body is specified in the certificate, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendations made by that body.

   

  (c)               Where -

   

  (i)                   the film classification body is not specified in the licence; or

   

  (ii)                            the relevant licensing authority has notified the premises which holds the certificate that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  (d)               In this section -

   

                              “children” means persons aged under 18; and

   

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

   

• CONDITION IMPOSED BY LICENSING PANEL  AT A HEARING ON 05 MAY 2010

   

  1.              No music or dancing permitted until an acoustic survey and any remedial works are completed to the satisfaction of Environmental Health.

   

  2.              No consumption of alcohol permitted in external area at rear of premises after 10:00 p.m.

   

  3.              The placing of bottles into receptacles outside the premises is not permitted to take place after/between the hours of 8pm and 8am to minimise disturbance to nearby properties on any day except Sunday when no such disposal shall take place before 10am.

   

  4.              Customers should be discouraged from using the exterior/front of the premises to smoke.

   

  5.              PS2 - Electrical Installation Testing

                The electrical installation shall be inspected and tested at intervals specified by a competent person.  A satisfactory and valid inspection report shall be available on site for inspection by an officer of the authority.

   

  6.              PS6 - First Aid

                There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.

   

  7.              PS1 - Gas Testing

                Any gas boiler, calorifier or other gas appliances will be tested at least every 12 months by CORGI authorised workmen and subsequent satisfactory and valid inspection report to be available on site for inspection by an authorised officer of the authority.

   

  8.              PS5 - Licensee Safety Inspection

                Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out by the licence holder to ensure that the premises are safe for use.

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

  1.              All windows at the premises to be kept closed when entertainment is provided.

   

  2.              Notices to be displayed at the premises requesting customers leaving the premises do so quietly.

   

  3.              An application is to be made for membership of the “PUBWATCH” scheme.

   

  4.              Lighting to outside of premises to enable customers to enter and leave safely.

   

  5.              Staff to monitor customer’s behaviour in an effort to prevent nuisance.

   

  6.              No unaccompanied children to be allowed on the premises.

   

  7.              ID to be inspected where staff suspect customers to be “under age”.
