• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

   

• CONDITIONS IMPOSED BY ENVIRONMENTAL HEALTH

   

  PPN9

  There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public notices pointing out the needs of local residents and the need to leave the premises and the area quietly. (Note:  this may also include reference to vehicles.)

   

  PPN14

  The placing of bottles into receptacles outside the premises is not permitted to take place between the hours of 2000 and 0800 to minimise disturbance to nearby properties.

   

  PPN10

  No explosive, firework or pyrotechnic shall be discharged in or from the premises which may cause a disturbance to the local area.  Notice of a proposed event shall be served on the Council, the Chief Fire Officer, the Environmental Health Officer and the Chief Police Officer, not less than 28 days before the proposed date of any such event.  Any such event shall be conducted in accordance with conditions or restrictions required by the Chief Fire Officer, the Environmental Health Officer and the Chief Police Officer.

   

  PS6 - First Aid

  There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.

   

  PS5 - Licensee Safety Inspection

  Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out by the licence holder to ensure that the premises are safe for use.

   

  PS1 - Gas Testing

  Any gas boiler, calorifier or other gas appliances will be tested at least every 12 months by CORGI authorised workmen and subsequent satisfactory and valid inspection report to be available on site for inspection by an authorised officer of the authority.

   

  PS2 - Electrical Installation Testing

  The electrical installation shall be inspected and tested at intervals specified by a competent person.  A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

  1.              Whenever the DPS is not at the premises a responsible person nominated by them will be left in charge of the management of the premises.

   

  2.              The premises is alarmed.

   

  3.              The DPS shall be an active member of a local Pubwatch for the area (if one exists in the area).  Either the DPS or a person nominated by them shall regularly attend the meetings and support the scheme.

   

  4.              The premises should comply with the Fire Precautions (workplace) Regulations 1997.

   

  5.              The fire equipment is checked annually.

   

  6.              All members of staff are aware of the location of the fire fighting equipment and how to use it.

   

  7.              Members of staff will ask people to leave quietly at the end of the evening.

   

  8.              Signs will be displayed at the entrance/exit to the premises asking customers to respect the residential neighbours.

   

  9.              At all times the DPS or other responsible person shall ensure the level of noise emitting from the premises shall be kept to a minimum.

   

  10.              Only persons aged 18 and over will sell alcohol (with the exception of persons on a government approved training scheme).

   

  11.              Any person who looks or appears to be under the age of 21 shall be asked to provide ID to prove that they are over the age of 18.  Only the UK photo driving license, passport or government approved PASS cards will be accepted as proof of age.

   

  12.              Proof of age checks will take place inside the premises by staff whenever they have doubt about a person’s age.
