• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.               No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.     The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010

   

  4.              (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

• CONDITIONS IMPOSED BY ENVIRONMENTAL HEALTH

   

  1.              There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public (or member and their guests) notices pointing out the needs of local residents and the need to leave the premises and the area quietly. (Note:  this may also include reference to vehicles.)

   

  2.              There shall be provided at the premises suitable and sufficient containers for the storage and disposal of waste foods and other refuse from the premises.  Those containers shall be constructed and maintained so as to prevent access, except by staff.

   

  3.              Where the premises provide food to the public for consumption on or off the premises they shall provide at or near the point of sale, sufficient receptacles to enable the disposal of waste food, food containers, wrapping etc.

   

  4.              No refuse, including bottles, shall be disposed of from the premises into a receptacle where such disposal is likely to cause a disturbance to residents in the area of the premises at any time between 8.00 pm and 8.00 am on any day except Sunday when no such disposal shall take place before 10.00 am.

   

  5.              PS5 - Licensee Safety Inspection

                Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out by the licence holder to ensure that the premises are safe for use.

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

  1.              All sales will be for consumption off  the premises.

   

  2.              The business will be run by the applicant who are the proprietors and hold personal licences.

   

  3.              All staff will be trained in aspects of licensed sales which includes dealing with young people.

   

  4.              Fire fighting equipment is on the premises and there are alternative exits.

   

  5.              The management and staff will be trained in dealing with liquor sales lawfully and responsibly.

   

  6.              The shop will operate an “under 25” age proof policy, with records of refused sales. 

   

  7.              The premises will have CCTV surveillance.

   

  8.              There is also a security alarm, with Redcare support.

   

  9.              The liquor displayed for sale is in the immediate vicinity of and protected by the shop counter.

   

  10.              Other stock is secure in a locked store room.

   

  11.              The premises are safe for public use and access.  Staff are responsible for keeping public areas clean and free from obstruction.

   

  12.              Access is by one shallow step only and the shop floor is all on one level.

   

  13.              Fire precautions include fire fighting equipment and emergency exit to the rear yard and side passage.

   

  14.              Congregations of people hanging about will be discouraged.
