• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.               No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.     The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory Condition where the licence authorises the exhibition of films

   

  (a)               Where a club premises certificate authorises the exhibition of films, the certificate must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this condition.

   

  (b)               Where the film classification body is specified in the certificate, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendations made by that body.

   

  (c)               Where -

   

  (i)                   the film classification body is not specified in the licence; or

   

  (ii)                            the relevant licensing authority has notified the premises which holds the certificate that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  (d)               In this section -

   

                              “children” means persons aged under 18; and

   

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010

   

  Condition numbers 1, 2 and 3 are effective from 6 April 2010 and conditions 4 and 5 are effective from 1 October 2010.  Please note the conditions 1, 2, 3 and 5 of the schedule do not apply where the licence or certificate authorises the sale by retail or supply of alcohol only for consumption off the premises. 

   

  1.              (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

                (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

  (a)               games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i)               drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii)               drink as much alcohol as possible (whether within a time limit or otherwise);

  (b)               provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

  (c)               provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  (d)               provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i)               the outcome of a race, competition or other event or process, or

  (ii)               the likelihood of anything occurring or not occurring;

  (e)               selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

  2.                The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

  3.                The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

  4.               (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

  5.                The responsible person shall ensure that-

  (a)               where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i)               beer or cider: ½ pint;

  (ii)               gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)               still wine in a glass: 125 ml; and

  (b)               customers are made aware of the availability of these measures.

   

   

• CONDITIONS IMPOSED BY ENVIRONMENTAL HEALTH

   

    1.              All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency.

   

    2.              Acoustic seals to be fitted to doors, stiles, jambs, heads and thresholds as per the submitted specification and diagrams for remedial works.

   

    3.              The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of the assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action.

   

    4.              Amplified music for regulated entertainment shall only be played in the ground floor performance space.

   

    5.              The noise level from regulated entertainment shall not exceed a level to be agreed with the Licensing Authority when measured internally in the ground floor performance area unless a scheme of noise insulation is agreed with the Licensing Authority. A means of ensuring achievement of this noise limit must be agreed with the Licensing Authority.

   

    6.              Live amplified music shall not be permitted unless a scheme of noise insulation has been agreed with the Licensing Authority and has been installed.

   

    7.              PS2 - Electrical Installation Testing

                The electrical installation shall be inspected and tested at intervals specified by a competent person.  A satisfactory and valid inspection report shall be available on site for inspection by an officer of the authority.

   

    8.              PS4 - RCD

                Each socket outlet circuit or individual socket outlets used for public entertainment shall be protected by an integral residual current device (RCD) having a rated residual operating current not exceeding 30mA (0.03 amps).  Every such circuit and residual current device shall  be inspected and tested at intervals specified by a competent  person.  A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.

   

    9.              PS5 - Licensee Safety Inspection

                Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out by the licence holder to ensure that the premises are safe for use.

   

  10.              PS6 - First Aid

                There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.

   

  11.              Over the duration of entertainment events the equivalent continuous sound pressure level (Event Leq) in any part of the audience area should not exceed 107dB(A).

   

  12.              The peak sound pressure level in the public area shall not exceed 120dB and shall normally be below 100dB for the duration of the event.

   

  13.              The audience should not be allowed within 3m of any loud speaker. Where this is not practical and suitable evidence of justification is provided, the overall music sound levels can be modified so that people closer than 3m to the loud speakers are not exposed to an Event Leq of more than 107dB(A) or peak sound pressure levels of 120dB. Under no circumstances should the audience and loudspeaker separation distance be less than 1m.

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

    1.              A staff training programme will be implemented to cover all four licensing objectives.  There are also steps to ensure that other main legislation is complied with such as the Health and Safety at Work Act and the Food Safety Act.

   

    2.              Please note the permission for sales off the premises will only be used on occasions when there are stalls or fairs or similar set up within the main hall and alcohol may be sold in this way.  It is not the intention that the bar or café should be used for sales other than for consumption on the premises.

   

    3.              The DPS is very aware of the need to run a premises of this nature and size in a way that does not have a negative impact on the neighbourhood or night time economy in Wigton and is happy to discuss any issues or questions that any representatives should have.

   

    4.              There is a comprehensive CCTV system in the premises with facility to record images.  The specification/plan has been forwarded to the police as part of the application.

   

    5.              There will be a comprehensive staff training programme in relation to the prevention of crime and disorder.

   

    6.              Where the DPS deems that an event requires door supervision, SIA registered door supervisors will be employed.

   

    7.              During events that involve live amplified music and public ticket sales, posters referring to the zero tolerance drugs policy and anti-drink drive messages will be displayed.

   

    8.              Events involving live amplified music and public ticket sales will have a terminal hour of midnight for the performance of live music.

   

    9.              The standing capacity of the venue as agreed with Cumbria Fire and Rescue is in the region of 500.  This will be restricted voluntarily during events involving entertainment to a maximum of 400 people.

   

  10.              There is a comprehensive fire detection and alarm installed.

   

  11.              Fire safety training has been completed with several members of staff.

   

  12.              As a community facility, there is every desire to avoid nuisance to the neighbourhood.  The walls of the building are extremely thick and pretty much soundproof.  The addition of the first floor facilities has further reduced the chance of noise escape by insulating the external roof.

   

  13.              Following a test by the DPS, one of the external fire escape doors has been fitted with an acoustic curtain made of DFR Premier Wool Serge which is also a flame retardant material.

   

  14.              The sprung dance floor and low ceiling height provide superb acoustics needing lower levels of amplification when equipment is being used.

   

  15.              Events involving live amplified music and public ticket sales will have a terminal hour of midnight for the performance of live music.

   

  16.              The DPS (or their representative) will monitor the noise levels during entertainment events by regularly checking the external noise levels.

   

  17.              The protection of children from harm - Staff will be trained thoroughly in this aspect of the Licensing Act 2003 and appropriate posters will be displayed at point of sale.  A refusals register will be kept at the bar and all staff will be trained in its use.
