  Mandatory conditions where licence authorises the supply of alcohol

   

  1.               No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.     The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010

   

  Condition numbers 1, 2 and 3 are effective from 6 April 2010 and conditions 4 and 5 are effective from 1 October 2010.  Please note the conditions 1, 2, 3 and 5 of the schedule do not apply where the licence or certificate authorises the sale by retail or supply of alcohol only for consumption off the premises. 

   

  1.              (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

                (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

  (a)               games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i)               drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii)               drink as much alcohol as possible (whether within a time limit or otherwise);

  (b)               provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

  (c)               provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  (d)               provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i)               the outcome of a race, competition or other event or process, or

  (ii)               the likelihood of anything occurring or not occurring;

  (e)               selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

  2.                The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

  3.                The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

  4.               (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

  5.                The responsible person shall ensure that-

  (a)               where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i)               beer or cider: ½ pint;

  (ii)               gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)               still wine in a glass: 125 ml; and

  (b)               customers are made aware of the availability of these measures.

   

   

• Agreed conditions recommended by Environmental Health

   

  Prevention of Nuisance

   

  Where regulated entertainment is provided by way of an in house PA system, management shall control such equipment to ensure nuisance is not caused.

   

  The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action.

   

  There shall be provided at the premises suitable and sufficient containers for the storage and disposal of waste foods and other refuse from the premises. Those containers shall be constructed and maintained so as to prevent access, except by staff.

   

  Where the premises provide food to the public for consumption on or off the premises they shall provide at or near the point of sale, sufficient receptacles to enable the disposal of waste food, food containers, wrapping etc.

   

  Public Safety

   

  Electrical Installation Testing

  The electrical installation shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an officer of the authority.

   

  First Aid

  There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.

   

  RCD

  Each socket outlet circuit or individual socket outlets used for public entertainment shall be protected by an integral residual current device (RCD) having a rated residual operating current not exceeding 30mA (0.03 amps). Every such circuit and residual current device shall  be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.

   

  Temporary Electrics

  Temporary electrical wiring and distribution systems shall be inspected and certified by a competent person before they are put into use. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.

   

  Temporary Structures

  Where the entertainment requires the provision of a temporary structure (e.g ring, certain stages, temporary seating, marquees) it shall be installed by a competent person. The Premises Licence Holder shall obtain a certificate from a competent person that the temporary structure has been correctly constructed and is fit for its intended use.

   

   

• Conditions consistent with operating schedule

   

  The risk assessed stewarding provision is set at 2 Event Managers provided by SK Events (Denise Harris and Anne-Louise Bouffard-Roupe) 1 x site manager  1x Event Control and Steward Manager (Dean Williamson), 1x Health and Safety Officer,   5X support staff will add additional support with a risk assessed provision of 10 Stewards and 5 SIA licensed officers.

   

  Event Control will be located at the Entrance Tent  of Main Street (see site plan)

   

  A Steward Control will be located on Main Street (see site plan)

   

  The event area has been designed so as to make it so far as is reasonable, accessible to all. All crowd management staff working the event have undergone DDA awareness training. The event organizer is aware of their responsibilities under the DDA legislation and has made provision by having stewards and security on site that are in full radio contact and will contact a member of the event management team where disabled access is needed. We have also installed one disabled toilet on site. A full brief will be given at the beginning of the event to ensure that no problems occur

   

  The Designated Premises License holder, Denise Harris, working alongside the event management team will work to ensure that all licensing objectives are met.

   

  The organizer will liaise with local transport providers to ensure they are aware of the likelihood of additional demand and a Park and Ride service will be running both days.

   

  A temporary taxi rank will be in place and all residents and visitors will be made aware of.

   

  A road closure letter will be circulated to local businesses and residents to make them aware of the festival and it will been advertised in the local press. 

   

  All marquee structures will be securely fitted along and inspected by the Health and Safety officer prior to the festival opening.  This will minimize the opportunity for tampering and interference with physical property.

   

  Stalls and marquees will be guarded by security staff from Friday evening until Sunday during the time of the breakdown until midnight. 

   

  The designated premises licence holder, Denise Harris, will work with all alcohol vendors to ensure that the strict rules regarding service of alcohol are followed and these rules will be clearly communicated to bars and restaurants both prior to and on the day of the festival.These include:

   

  Display of the Challenge 21 sign in any area where alcohol is available

   

  No glass is permitted at the festival, meaning that all alcohol must be decanted into plastic cups. 

   

  At the first signs of intoxication, customers will be refused service.

   

  SIA registered security staff will actively monitor the beer tent throughout the day and will stay in constant radio communication with event management staff.

   

  An application for road closure has been submitted and will entail closure of Main Street.  Thus Main Street will be pedestrian only between Friday 24th September 11pm and Sunday 26th September at midnight.

   

  A traffic management plan will be in place with the principal objectives of; ensuring safe pedestrian road use and maintaining visibility for vehicles in the direct vicinity, and preventing traffic build up.

   

  Traffic stewards will be present at the start of the diversion in order to monitor the volume of incoming vehicles and advise drivers of the most appropriate route when necessary. Please see the site map for details of the traffic management plan.

   

  It is expected that there will be fluid crowd movement around Cockermouth rather than inermittent surges. The nominated Health and Safety office will monitor crowd tendencies throughout the day.   However in the event of a surge in numbers visitors can be easily directed away from the site as it is completely open.   Please see site map for the principal points of ingress and egress. 

   

  All crowd management personnel will be trained to FSQ Level 2 or equivalent or as necessary in accordance with legislation. The organiser will instruct the stewarding to monitor and report on crowd behaviour and where appropriate take action using SIA staff.

   

  The organiser after consulting the joint agencies should steward the identified points and road closures in order to control ingress/stop ingress to the site or part of it using barriers located at each strategic point

   

  Stewarding Roles

   

  A register of all stewards on duty must be kept on site. 

   

  All steward supervisors MUST be SIA registered to undertake their role as in addition to general stewarding duties they will undertake security roles should it become necessary.

   

  General duties of steward

   

  To provide information to the public as to site layout and facilities

  To provide information to the public as to the running order/timings of activities

  To monitor and report on crowd densities

  To monitor and report on the general welfare of the crowd

  To assist the Police as directed

  To control access to restricted areas

  To assist in extraction of persons experiencing difficulties, especially at a front of house barrier

  To assist in evacuation should it become necessary to do so

  To assist the emergency services as directed

   

  Major Incident Response Procedure

   

  Each marquee area will be subject to a small-scale event contingency plan. The decision to implement to the full-scale joint agency contingency plan is that of the Police/Fire/Ambulance depending on the nature of the emergency, and is covered in the assumption of control section.

   

  The general responsibilities of Event Management in responding to a major incident may be summarised as follows:

   

  •              To alert emergency services

  •              To manage the scene until emergency services arrive

  •              To provide accurate information to Emergency Services

  •              To liaise with the Emergency Services

  •              To assist in an emergency evacuation if called to under the direction of the Police.

  •              To continue to provide stewarding staff after the evacuation under the command of the Police.

   

  If the site does reach its occupant capacity, or if public highway levels at which action is necessary. (This can be assessed by the methods outlined under the heading Ingress and in Crowd Management section), the Event Organiser after consulting the joint agencies should steward the identified points including road closures in order to support the police in the of control ingress/stop ingress to the site or part of it.

   

  This is an outdoor event with surrounding buildings and structures. 

   

  •              Use of event infrastructure with valid fire safety certificates.

  •              Co-ordinate approach to planning with emergency services.

  •              Use of trained security and stewards, advised of location of firefighting equipment.

  •              Prohibition of the use of petrol generators

  •              LPG to be used in accordance with current guidance (See Event safety Guide and Mobile Outdoor Catering Associations.)

  •              Power supply and distribution to be installed by qualified electrician only.

  •              All working personnel used on site to be briefed on fire evacuation policy to enable them to take a proactive approach

   

  Noise

   

  Hours of operation are between 12:00 and 18:00 and will therefore not cause late night noise.

  Chef demos and specialist producers will do microphoned talks but will be minimally audible from outside the tent.

  Performances of live music by an acoustic folk band will be kept to low enjoyable background music.

  There will be no external lighting or flood lights or security lighting on the street since the streetlamp infrastructure is already in place. 

   

  Refuse

   

  Infrastructure in terms of 8 tonne skips and 50 240ltr wheely bings to be continually emptied throughout the day

  Collection of litter from around open dining area tables - a team of 20 litter pickers who are paid to specifically keep the site clean at all times

  The contact ensuring the site is clean at the deconstruction stage will be Denise Harris.

  There is in place a comprehensive and detailed waste and cleansing programme.

  Noise and waste controls are in place

   

  Protection of Children From Harm

   

  Location of lost child point will be clearly visible with prominent signage

  Separate facilities for separated minors will be provided and staffed by registered child minders/carers.

  Records of children reported as separted will be collated to ensure appropriate levels of support are maintained

  Each stall/hut holder is required to provide relevant food hygiene certificates and equipment inspection documentation prior to the event. The design of the hut structure is such that small children ae unable to reach any hazardous equipment.
