• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.               No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.     The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) (Amendment) Order 2014

  1.               (1)              The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2)               In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

  (a)               games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

  (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

  (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

  (d)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e)              dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

  2.               The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

  3.                (1)                The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2)               The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3)               The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a)              a holographic mark, or

  (b)              an ultraviolet feature.

  4.                The responsible person must ensure that-

  (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i)              beer or cider: ½ pint;

  (ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)              still wine in a glass: 125 ml;

  (b)              these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c)              where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2014

   

  1.               A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  2.               For the purposes of the condition set out in paragraph 1 -

   

  (a)               “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(6);

  (b)               “permitted price” is the price found by applying the formula -

   

  P = D + (D x V)

   

  Where -

   

  (i)               P is the permitted price,

  (ii)               D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii)               V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

   

  (c)                “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

   

  (i)               the holder of the premises licence,

  (ii)               the designated premises supervisor (if any) in respect of such a licence, or

  (iii)               the personal licence holder who makes or authorises a supply of alcohol under such a licence;

   

  (d)               “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

   

  (e)              “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994(7).

   

  3.              Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  4.              (1)               Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

   

                (2)               The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

   

• CONDITIONS IMPOSED BY ENVIRONMENTAL HEALTH

   

  1.              4 weeks prior to the commencement of the festival every year the applicant shall submit details of the programme which shall include:

   

  Venue(s)

  Time(s)

  Predicted attendance numbers

  Details of temporary structures

  An Event Management Plan and,

  Noise Management Plan

   

  The following conditions apply to the 2011 event:-

   

    2.              Noise assessments

                The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action.

   

    3.              Control of PA system

                Where regulated entertainment is provided by way of an in house PA system, management shall control such equipment to ensure nuisance is not caused.

   

    4.              Waste

                There shall be provided at the premises suitable and sufficient containers for the storage and disposal of waste foods and other refuse from the premises. Those containers shall be constructed and maintained so as to prevent access, except by staff.

   

    5.              Waste receptacles

                Where the premises provide food to the public for consumption on or off the premises they shall provide at or near the point of sale, sufficient receptacles to enable the disposal of waste food, food containers, wrapping etc.

   

    6.              Clearing of waste

                Where the premises provide food for consumption off the premises, the public area immediately surrounding the premises shall be cleared of waste food, food containers, wrapping etc at the end of trading on each day. Such refuse shall be placed in a container designed for the storage and disposal of refuse and waste foods which shall be constructed and maintained so as to prevent access, except by staff.

   

    7.              Gas Testing

                Any gas boiler, calorifier or other gas appliances will be tested at least every 12 months by Gas Safe authorised workmen and subsequent satisfactory and valid inspection report to be available on site for inspection by an authorised officer of the authority.

   

    8.              Temporary Electrics

                Temporary electrical wiring and distribution systems shall be inspected and certified by a competent person before they are put into use. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.

   

    9.              RCD

                Each socket outlet circuit or individual socket outlets used for public entertainment shall be protected by an integral residual current device (RCD) having a rated residual operating current not exceeding 30mA (0.03 amps). Every such circuit and residual current device shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.

   

   

  10.              Licensee Safety Inspection

                Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out by the licence holder to ensure that the premises are safe for use.

   

  11.              First Aid

                There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.

   

  12.              Temporary Structures

                Where the entertainment requires the provision of a temporary structure (e.g ring, certain stages, temporary seating, marquees) it shall be installed by a competent person. The Premises Licence Holder shall obtain a certificate from a competent person that the temporary structure has been correctly constructed and is fit for its intended use.

   

  13.              Sanitary Accommodation

                Based on a 50/50 split (male/female), the minimum toilet provision for the event must be:

   

  Female: 1 WC per 100 females

  Male:              1 WC per 500 males, 1 urinal per 150 males

  Wash hand basins to be provided at a ratio of one per five toilets

   

                Adequate and suitable toilet facilities shall be provided for the use of disabled individuals. The conveniences shall be indicated by suitable signage and be efficiently lit at all times. The conveniences shall be kept, at all times, in good order and repair and properly and effectively cleansed and maintained throughout the duration of the event.

   

  14.              Noise measures - audience protection

   

  (a)              Over the duration of the event the equivalent sound pressure level (Event Log) in any part of the audience area should not exceed 107dB(A).

   

  (b)              The peak sound pressure level in the public area shall not exceed 120dB and shall normally be below 100dB for the duration of the event.

   

  (c)              The audience should not be allowed within 3m of any loud speaker. Where this is not practiced and suitable evidence of justification if provided, the overall music sound levels can be modified so that people closer than 3m to the loud speakers are not exposed to an Event Log of more than 107dB(A) or peak sound pressure levels of 120dB. Under no circumstances should the audience and loudspeaker separation distance be less than 1m.

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

    1.              On the day before the festival we hold a stewards briefing which covers all aspects of general duties, public safety and emergency procedures.

   

    2.              Stewards are issued with an identity badge showing their name.  On the reverse side of the badge are emergency telephone contacts.

   

    3.              Duty Stewards must wear the yellow glow jackets provided.

   

    4.              Throughout the festival period we have a roster of roving stewards who work in pairs.  Their role is to be aware of what’s happening in and around the village and call for assistance if necessary.

   

    5.              Duty stewards and key personnel are in constant 2 way radio contact with the festival Director.  A programme of events will be submitted to the Licensing Department at least one month in advance of the festival each year.

   

    6.              Two weeks prior to the festival a strategy meeting is held with the local police and key members of the festival group.

   

    7.              On the nights of the festival from 22.00hrs to 06.00 hrs professional security guards (Safe & Sound Security Ltd, Fisher Street, Carlisle) patrol the area.

   

    8.              Admission to the festival is by ticket purchased in advance* and exchanged for a wristband at the festival office.  Tickets for young people under the age of 17 can only be purchased with an adult ticket.

   

                *  tickets are available on the day for Saturday afternoon performances; the same age  

                              restriction principal is applied.

   

    9.              Camping is only permitted if purchased with an adult ticket.

   

  10.              A comprehensive risk assessment is undertaken to determine and reduce potential risk to members of the public.  We work closely with Allerdale Health and Safety officers and are guided by their professional advice.

   

  11.              More than 40 volunteer stewards who are familiar with Ireby and the festival will be on duty throughout the festival period.  At any given time at least 6 stewards will be in the main marquee area.

   

  12.              A designated one way car park system is in use and key road junctions leading in and out of the parking area are manned by stewards.

   

  13.              During the course of the festival all portable toilets on site are emptied, cleaned and disinfected by the hire company.

   

  14.              Fire points and fire extinguishers are clearly identified.

   

  15.              Trained First Aiders are on hand throughout the festival period.

   

  16.              A member of the Parish Council is also an active member of the festival group and is in a position to advise us of any local issues that may need to be addressed.

   

  17.              The weekend prior to the festival an information sheet is circulated to all residents to bring them up-to date with festival activities.

   

  18.              Portable toilets (identified in condition 13. above) will supplement permanent toilets situated in other music venues.

   

  19.              An ample supply of waste collection/re-cycle bins is hired in and distributed across the festival area.

   

  20.              We have a designated professional child and vulnerable adult protection officer on site or readily contactable.

   

  21.              All stewards are made aware of the festival child protection policy and action sheet, a copy of which is available at the festival office, this is the main contact point for responding to Radio communication messages and calling for emergency assistance if needs be.

   

  22.              The festival office is also the main point of contact for found or missing children.

   

  23.              All ticket holders are issued with a festival wrist band that has to be visible to festival staff and worn at all times.
