CONDITIONS IMPOSED BY ENVIRONMENTAL HEALTH
1. Control of PA system
Where regulated entertainment is provided by way of an in house PA system, management shall control such equipment to ensure nuisance is not caused.
2. Notices
There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public (or member and their guests) notices pointing out the needs of local residents and the need to leave the premises and the area quietly. (Note: this may also include reference to vehicles.)
3. Bottle disposal
The placing of bottles into receptacles outside the premises is not permitted to take place after/between the hours of 8pm and 8am to minimise disturbance to nearby properties on any day except Sunday when no such disposal shall take place before 10am.
4. Fixed plant and equipment
All fixed plant and equipment at the premises that produce significant levels of noise are fitted with appropriate means of noise suppression and are restricted in their use so as to minimise disturbance to any neighbouring noise sensitive premises.
5. Light
No light from or on the premises and any other light under the control of the premises shall cause nuisance to any nearby premises.
Noise Management (Conditions 6 - 14)
6. A Noise Management Plan must be submitted to the Environmental Health at least two months prior to the first day of the event. This must cover all aspects of the day and in particular, steps to be taken to manage noise pollution, number of stages, location, orientation and operational times of each stage. This must be received and agreed by the department before the event commences. It should also include details of the sound system being used, noise predictions to assess noise levels at noise sensitive properties surrounding the event site and details of sound control and monitoring scheme that will be put into place to minimise noise levels to achieve compliance with the conditions of this licence.
7. The licence holder, representative or noise control consultant shall conduct regular assessments (hourly) of the noise coming from the festival site and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents.
A written record shall be made of those assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action. Three monitoring locations will be used and these are shown on the attached plan and they are:
(a) Near Tarn, Stainburn Road, Stainburn, Workington CA141SZ.
(b) Stainburn Hall Cottage, Stainburn Road, Stainburn, Workington, CA141SY
(c) Land next to 57 Riverside, Great Clifton, CA141TF
A copy of these logs should be maintained and submitted to Environmental Health within seven days of the event.
8. The licensee shall appoint a suitably qualified and experienced noise control consultant, who shall liaise between all parties including the licensee/promoter, sound system supplier, sound engineer and the licensing authority on all matters relating to noise control.
9. The use of noise limiters are advised for the stages as this sets a maximum volume for the music. It is also important to set maximum levels for the low frequency levels (bass) as these cause the most disturbance to local residents. By doing this you can comply with condition 5.
10. One of the most frequently encountered problems is that an unnecessarily large amount of sound equipment is provided, which makes effective control very difficult. The output of the sound system(s) should be suitable for the size of the event, and as a general rule it should be calculated on the basis of 1KW per 100 people in the audience expected.
11. The noise levels emanating from the site for all live amplified music/entertainment when measured at the monitoring locations (as specified in condition 1) shall not exceed an equivalent continuous sound pressure level (LAeq) of 60 dBA. In particular, this will apply to the 63Hz and 125Hz octave frequency bands.
12. A contact name and number should be provided to the Environmental Health Department prior to the event and it is recommended that there is a letter drop at the nearest noise sensitive properties before the event providing a contact name and number for complaints. These complaints should be logged and the Duty Manager will investigate the noise and take appropriate action to locate and reduce the source and will then continue to monitor the situation and provide a report to both complainant and the Environmental Health Department. A log of complaints must be submitted to Environmental Health within seven days of the event.
13. The music noise levels during each Event shall be measured using a calibrated integrating averaging sound level meter complying with Type 2 or better of BS6698. A weighted F (fast response) shall be used.
14. If an officer of Environmental Health believes that the levels audible outside the premises are unacceptable then, at the request of the Officer, the noise control consultant shall adjust the volume of sound accordingly to the requirements of the Officer.
15. Gas Testing
Any gas boiler, calorifier or other gas appliances will be tested at least every 12 months by Gas Safe authorised workmen and subsequent satisfactory and valid inspection report to be available on site for inspection by an authorised officer of the authority.
16. Electrical Installation Testing
The electrical installation shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an officer of the authority.
17. Temporary Electrics
Temporary electrical wiring and distribution systems shall be inspected and certified by a competent person before they are put into use. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.
18. RCD
Each socket outlet circuit or individual socket outlets used for public entertainment shall be protected by an integral residual current device (RCD) having a rated residual operating current not exceeding 30mA (0.03 amps). Every such circuit and residual current device shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.
19. First Aid
There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.
20. Noise measures - audience protection
(1) Over the duration of the event the equivalent sound pressure level (Event Log) in any part of the audience area should not exceed 107dB(A).
(2) The peak sound pressure level in the public area shall not exceed 120dB and shall normally be below 100dB for the duration of the event.
(3) The audience should not be allowed within 3m of any loud speaker. Where this is not practiced and suitable evidence of justification if provided, the overall music sound levels can be modified so that people closer than 3m to the loud speakers are not exposed to an Event Log of more than 107dB(A) or peak sound pressure levels of 120dB. Under no circumstances should the audience and loudspeaker separation distance be less than 1m.
21. Sanitary Accommodation
Based on a 50/50 split (male/female), the minimum toilet provision for the event must be:
Female 1 WC per 100 females
Male 1 WC per 500 males, 1 urinal per 150 males
Wash hand basins to be provided at a ratio of one per five toilets
Adequate and suitable toilet facilities shall be provided for the use of disabled individuals. The conveniences shall be indicated by suitable signage and be efficiently lit at all times.
The conveniences shall be kept, at all times, in good order and repair and properly and effectively cleansed and maintained throughout the duration of the event.
22. Arrangements for Refuse
There shall be provided at the venue suitable, sufficient and secure containers for the storage and disposal of waste on the site. Adequate arrangements should be made for emptying the containers.
. Where the premises provide food for consumption off the premises, the public area immediately surrounding the premises shall be cleared of waste food, food containers, wrapping etc at the end of trading on each day. Such refuse shall be placed in a container designed for storage and disposal of refuse and waste foods which shall be constructed and maintained so as to prevent access, except by staff.
23. Licensee Safety Inspection
Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out by the licence holder to ensure that the premises are safe for use.
24. Camping
Prior to the event dates the layout for the camping area must be in place and any traffic routes clearly marked.
25. Overhead power lines
No flagpoles tent poles, plant or equipment should be erected under or adjacent to the overhead power lines. Safe working procedures for this area must form part of your risk assessments.
