• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  1.               No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.     The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010

   

  Condition numbers 1, 2 and 3 are effective from 6 April 2010 and conditions 4 and 5 are effective from 1 October 2010.  Please note the conditions 1, 2, 3 and 5 of the schedule do not apply where the licence or certificate authorises the sale by retail or supply of alcohol only for consumption off the premises. 

   

  1.              (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

                (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

  (a)               games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i)               drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii)               drink as much alcohol as possible (whether within a time limit or otherwise);

  (b)               provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

  (c)               provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  (d)               provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i)               the outcome of a race, competition or other event or process, or

  (ii)               the likelihood of anything occurring or not occurring;

  (e)               selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

  2.                The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

  3.                The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

  4.               (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

                (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

  5.                The responsible person shall ensure that-

  (a)               where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i)               beer or cider: ½ pint;

  (ii)               gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)               still wine in a glass: 125 ml; and

  (b)               customers are made aware of the availability of these measures.

   

• CONDITIONS IMPOSED BY ENVIRONMENTAL HEALTH

   

  1.              Noise protection for audience

   

  The A-weighted equivalent continuous sound level over the duration of the event (Event LAeq) in any part of the audience area should not exceed 107 dB, and the C-weighted peak sound pressure level should not exceed 140 dB. The above sound level exposure values are for the whole of the audience area.

   

  The audience should not be allowed within 3m of any loudspeaker.

   

  Where the Event LAeq is likely to exceed 96dB, advise the audience of the risk to their hearing in advance.

   

  Pyrotechnics should be restricted so that at head height in the audience area, noise from pyrotechnics does not exceed a C-weighted peak sound pressure level of 140 dB.

   

  2.              Sanitary accommodation

   

  Provide sanitary accommodation in accordance with the following:

   

  Female 1 toilet per 100 females

  Male     1 toilet per 500 males

               1 urinal per 150 males

   

  3.              Hand wash facilities

   

  Provide hand wash facilities in the ratio of one per five toilets. Hand washing facilities to have running water.

   

  Where warm water hand washing facilities are available provide adequate supplies of suitable soap. Antiseptic hand wipes or bactericidal soap should be provided where warm water is not available.

   

  Provide suitable hand drying facilities. If paper towels are supplied, arrange for regular disposal and restocking.

   

  4.              Sanitary provision for people with special needs

   

  Provide one toilet with hand wash facilities per 75 people with special needs. A minimum of one toilet and hand wash facilities is required.

   

  5.               Control of PA system

  
  Where regulated entertainment is provided by way of an in house PA system, management shall control such equipment to ensure nuisance is not caused.

   

  6.               Notices

  
  There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, notices pointing out the needs of local residents and the need to leave the premises and the area quietly.

  
  7.               Fixed plant and equipment
   

  All fixed plant and equipment at the premises that produce significant levels of noise are fitted with appropriate means of noise suppression and are restricted in their use so as to minimise disturbance to any neighbouring noise sensitive premises.
   

  8.               Light

  
  No light from or on the premises and any other light under the control of the premises shall cause nuisance to any nearby premises.
   

  9.               Noise Management

   

  A working Noise Management Plan is in place for each annual event and shall be updated on an annual basis. The updated plan shall be submitted to Environmental Health two months prior to each event. Additional to this plan:

   

  (a)              the licence holder, representative or noise control consultant shall conduct regular assessments (hourly) of the noise coming from the festival site and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents.
  
  A written record shall be made of those assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action. One monitoring location will be used, this is:

   

  i)              1 Marine Road, Maryport, CA15 8AY
  
  A copy of these logs should be maintained and submitted to Environmental Health within seven days of the event.
   

  (b)              The noise levels emanating from the site for all live amplified music/entertainment when measured at the monitoring location shall not exceed an equivalent continuous sound pressure level (LAeq) of 60 dBA. In particular, this will apply to the 63Hz and 125Hz octave frequency bands.
   

  (c)              A contact name and number should be provided to the Environmental Health Department prior to the event and it is recommended that there is a letter drop at the nearest noise sensitive properties before the event providing a contact name and number for complaints. These complaints should be logged and the Duty Manager will investigate the noise and take appropriate action to locate and reduce the source and will then continue to monitor the situation and provide a report to both complainant and the Environmental Health Department. A log of complaints must be submitted to Environmental Health within seven days of the event.
   

  (d)              The music noise levels during each Event shall be measured using a calibrated integrating averaging sound level meter complying with Type 2 or better of BS6698. A weighted F (fast response) shall be used.
   

  (e)              If an officer of Environmental Health believes that the levels audible outside the premises are unacceptable then, at the request of the Officer, the noise control consultant shall adjust the volume of sound accordingly to the requirements of the Officer.

   

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

    1.              To have on site a well organised and well informed team of stewards to oversee the whole of the event and its grounds.

   

    2.              There will be also at all times of opening, 8 SIA trained staff (Excalibur security), accompanied with 14 stewards on shift at all times.

   

    3.              There will be at least 1 of the 2 supervisors on duty at all times of opening.  This is in addition to the senior stewards and senior door supervisor.

   

    4.              Bottle ban - no removal of alcohol from the premises, plastic glasses and cans only to be served.

   

    5.              Organisers policy on excluding disruptive customers and selling drunk/underage persons.

   

    6.              No more than 800 persons to be in the marquee at any one time.

   

    7.              Contact to be available directly to the police at all times.  Via radio.

   

    8.              Capacity limits to the marquee.

   

    9.              First aid provision - first responders and SIA staff.

   

  10.              Door control - SIA trained staff and use of stewards.

   

  11.              Seating areas with vendors and seating for trawler race presentation.

   

  12.              Limited trading times.

   

  13.              Limiting music times - live or recorded.

   

  14.              Regular sound assessments from designated positions.

   

  15.              Toilets.

   

  16.              Security - SIA trained staff.

   

  17.              Children (under 18) to be from the premises no later than 1900 hrs.

   

  18.              Child welfare arrangements - designated assembly points.

   

  19.              No child to be admitted without a responsible adult.

   

  20.              Challenge 21 at the bar to be in operation.
