• LICENSING ACT 2003 MANDATORY CONDITIONS

   

  Mandatory Condition where the licence authorises the exhibition of films

   

  (a)               Where a club premises certificate authorises the exhibition of films, the certificate must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this condition.

   

  (b)               Where the film classification body is specified in the certificate, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendations made by that body.

   

  (c)               Where -

   

  (i)                   the film classification body is not specified in the licence; or

   

  (ii)                            the relevant licensing authority has notified the premises which holds the certificate that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  (d)               In this section -

   

                              “children” means persons aged under 18; and

   

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

   

   

• CONDITIONS IMPOSED BY ENVIRONMENTAL HEALTH

   

    1.              All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency.

   

    2.              The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include the time and date of the checks, the person making them and the results including any remedial action.

   

    3.              There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public notices pointing out the needs of local residents and the need to leave the premises and the area quietly. (Note: this may also include reference to vehicles.)

   

    4.              All entrances and exits have a lobby entrance with at least one set of doors closed at all times to minimise the breakout of noise.

   

    5.              The playing of live or recorded music in garden areas and other external spaces of the premises is not permitted.

   

    6.              There shall be provided at the premises suitable and sufficient containers for the storage and disposal of waste foods and other refuse from the premises. Those containers shall be constructed and maintained so as to prevent access, except by staff.

   

    7.              No refuse, including bottles etc. shall be disposed of from the premises into a receptacle where such disposal is likely to cause a disturbance to residents in the area of the premises at any time between 8.00 pm and 8.00 am on any day except Sunday when no such disposal shall take place before 10.00 am.

   

    8.              No light from or on the premises and any other light under the control of the premises shall cause nuisance to any nearby premises.

   

    9.              PS2 - Electrical Installation Testing

                The electrical installation shall be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an officer of the authority.

   

  10.              PS4 - RCD

                Each socket outlet circuit or individual socket outlets used for public entertainment shall be protected by an integral residual current device (RCD) having a rated residual operating current not exceeding 30mA (0.03 amps). Every such circuit and residual current device shall  be inspected and tested at intervals specified by a competent person. A satisfactory and valid inspection report shall be available on site for inspection by an authorised officer of the authority.

   

  11.              PS6 - First Aid

                There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials for the use of customers.

   

   

   

• CONDITIONS CONSISTENT WITH OPERATING SCHEDULE

   

    1.              The Parish Hall Committee will ensure the new parish hall is kept in good repair, with the appropriate annual inspections (fire prevention, electric) carried out.

   

    2.              The Committee will also do risk assessments periodically.

   

    3.              A security alarm system will be installed in the new building.

   

    4.              In order to confirm a booking, hirers must complete a ‘Booking Form’ and sign a ‘Conditions of Hire’ Agreement.  The latter will state clearly guidelines in the use of the hall and the licensing restrictions.  The appropriate signed section is returned to the booking secretary and the hirer retains the ‘Conditions of Hire’ for reference.

   

    5.              There will be a restricted number of key holders and the hall will be locked when not in use.

   

    6.              Being a new building, public safety will be a high priority.

   

    7.              There is a ramped path to the main entrance which will have an automatic push pad opening system suitable for wheel chair users.

   

    8.              A fire alarm system will be installed and fire equipment placed at appropriate points.

   

    9.              A fire safety risk assessment will be carried out at regular intervals.

   

  10.              The block paved car park is on one level with adequate lighting and is clearly visible from the road side.

   

  11.              Hirers will be encouraged to use the hall car park, thus minimizing parking inconvenience along Matty Lonning.

   

  12.              The ‘Conditions of Hire’ will ask hirers specifically to be considerate of the residents nearby, particularly at events when music is played.

   

  13.              This new hall is very well insulated and has double glazing throughout.  The retention of sound should be therefore far better than in the old hall.

   

  14.              All cleaning materials will be kept in a clearly marked cupboard in the kitchen or locked storeroom, the furniture and fixtures will be well maintained.

   

  15.              All children’s group leaders are aware of their own responsibilities regarding children/adult ratios and no children will be allowed in the building without adult supervision.

   

  16.              The plant room and store areas not required by a children’s group will be locked.
